Broke the car further, then tried to blame it on us
We brought our Mustang to Baker's after someone rear ended us at Christmastime. They got the car in February, around Valentine's Day; it is now May 10 and we haven't gotten the car back yet. We understand parts are taking longer than usual to arrive, so we gave some grace with the extended period of time to repair; however, when we called for an update yesterday, the receptionist gave attitude and basically said "it'll be done when it's done". Then, this morning we received a call from the owner. He said that the car will no longer go into gear, that there must have been an underlying problem, and that we'll have to have the car towed to whatever shop last rebuilt the transmission to have it fixed.
ABSOLUTELY NOT, CHIEF.
The car was driveable when it came to Baker's. It was driven home from the accident scene. It was driven twice between then and when it went to Baker's. It was driven TO Baker's on the day it was dropped off. Baker's drove it (they said) 10 times while it's been with them. Only when he went to test drive the car this morning, supposedly, to make sure all repairs were good and return the car to us, did it suddenly get stuck in gear. He slipped up and said that he had to fire a tech sometime in between - which tells us it's very likely somebody forced the car into gear and broke something.
It was fully explained to the owner when the car was dropped off that the car has an aftermarket shifter, that the reverse has a push-down lockout, and that it's not marked. If they broke the car, that's on them. They've been told they have three days from today to fix the problem, or we will be getting a lawyer. We should not be charged to fix a problem they created.
